President Trump’s newly-enacted policy of denying asylum to illegal aliens who first passed through another country prior to entering America has been re-implemented, as per a report from Politico.
U.S. District Court Judge Jon Tigar of San Francisco has ordered a nationwide injunction on the policy, which would require immigrants to seek asylum in the first country that they entered after leaving their home countries.
However, the Trump Administration requested a stay on the injunction, which was ultimately granted by the 9th Circuit Court of Appeals. This now limits the injunction to only states that are within the 9th Circuit, while the policy can now be enforced in all other states.
A number of President Trump’s immigration policies that were initially stopped by rulings from lone federal judges have gone on to be ruled constitutional, such as the travel ban of 2017. Attorney General William Barr has openly criticized the notion of individual judges being able to issue nationwide injunctions, and recently wrote an op-ed in the Wall Street Journal criticizing the practice.
